We had a very good 2021-22 with the 2,000 allocation of nomination places nearly met. We averaged 171 approvals a month and had a 19 per cent refusal rate.

 

One of the main reasons for refusing was the evidence of current employment. All applicants must successfully demonstrate that they are currently employed in a genuine position, which is separate from demonstrating your employment points claims. Please read our guidelines carefully before submitting applications. 

 

 

ACT Critical Skills List - to be published on Friday 24 June

 

Attached is a copy of the revised ACT Critical Skills list. When compiling the ACT Critical Skills list, we rely on a wide range of indicators, including but not limited to vacancy rates, employment levels, projected employment growth, and predicted retirements per occupation as well as industry and stakeholder feedback. The list will be published on our website at 9am on Friday 24 June. Increasing skills shortages mean that 95 occupations will be added to our critical skills list and 3 occupations will be removed.

 

Small Business Owner pathway

 

We have had an increasing number of questions about the Small Business Owner pathway (SBO). I therefore wanted to take the time to briefly clarify the process we use to determine what scores will receive an invitation under this category. As per our guidelines, the highest ranked Matrix will be invited to apply for ACT 491 / 190 SBO nomination. The cut-off for selection depends on demand. Following an invitation round, we assess the average minimum score required to receive an invitation in each visa subclass. The cut-off will be at, or just below, this average.

 

Application for Renomination

 

I just wanted to remind everyone that the ACT maintains (and will continue to maintain) a strict one nomination place per person policy. We have limited nomination places available and a growing demand for skilled workers. If an ACT nomination goes unused, the Territory has a reduced capacity to fill workforce shortages. Moreover, it is not fair to the thousands of applicants in the Matrix queue if their chance of ACT nomination is lost because someone else was given two nomination places. As such, please remind your clients that they should think carefully before accepting an invitation. In particular, make sure that the Skill Select EOI responses are correct before submitting the application for ACT nomination.

 

Mandatory Statutory declaration

 

Please remind your clients that the statutory declaration is mandatory. The statutory declaration must declare that they are employed in a genuine position. Please consult our guidelines for further details.

 

Home Affairs integrity – the statutory declaration will be sent to Home Affairs if we are concerned about the genuine nature of the employment. We also have system checks in place to monitor for employment churn.

 

2022-23 Allocation of ACT nomination places

 

The allocation split of 491 and 190 nomination places will likely remain. As such, your clients are more likely to be invited under the 491 pathway. You need to advise them accordingly and manage their expectations. Depending on the occupation and demand, we expect minimum scores for invitation for 190 nomination to remain high (i.e. around 85 points or higher) while the 491 minimum score required will be lower (i.e. likely 65 points or above). Note that these scores are not a guarantee nor are they set in stone, the actual figures will ultimately depend on our allocation, the number of Matrix submissions, and the Matrix scores we receive.

We already have over 2300 eligible 491 Matrix with 65 plus points in the queue, and over 400 190 Matrix in the queue with 85 points plus.

Invitations will likely be issued on a fortnightly basis, depending on the number of applications lodged with a minimum of one invitation round per month. Note that this is an indication, the actual number of invitation rounds may differ based on allocation, demand, and processing capacity.
